Public contract (offer)

Crocos LLP (Krokos), referred to as” Operator”, offers to any individual or legal entity, referred to as” Buyer”, paid services on the Internet (hereinafter – services).

This offer in accordance with Art. 395 of the civil Code of the Republic of Kazakhstan is a public offer (following – the Contract), full and unconditional acceptance (acceptance) of the terms of which in accordance with Art. 396 of the civil code of the Republic of Kazakhstan is considered to be the Buyer of the conclusory actions – pressing The “I agree with the terms of the agreement” located on the Operator’s website.

1 TERMS AND DEFINITIONS

Within the framework of this offer, the terms and definitions given below are used equally in singular and plural, unless otherwise follows from the meaning of the term and / or definition, in the following meanings:

  • Users / Subscribers – persons registered on the operator’s resource in the prescribed manner.
  • Acceptance – acceptance of the terms of the Offer, by concluent action, i.e. by pressing the button “I agree to the terms of the Agreement»

  • Personal account – section on the site, available to the Buyer after registering an account on the site.
  • Agent resources – a Web site operator posted on www.CityPASS.kz all domains of the next levels related to the Resource of the operator.
  • Point of sale – CityPASS card sales office, owned by The Operator and/or sub-agents of the Operator, to third parties involved by the Operator in order to implement the cards.
  • City Pass – a single card for tourists with a continuous validity in hours: 72 hours (3 days).
  • Card validity period – the period of time when cards can be activated, i.e. within 12 months after purchase. The beginning of activation is the moment of electronic scanning, manual entry of data from the map or entering an appropriate entry in the guide when visiting the museum or excursion for the first time.
  • Validity of the card – the period of time in hours, 72 hours (3 days).
  • Activation of the card – the moment of electronic scanning, manual entry of data from the Card or making an appropriate entry in the guide at the first visit to the Museum or tour.
  • Activated map – the map that made the first one-time pass to a Museum or on a tour.
  • Returned card – a card on which a refund was made to the User.

2. SUBJECT OF CONTRACT

2.1. The operator provides the buyer with the opportunity to buy CityPASS cards for sightseeing and excursions in Astana via the Internet.

2.2. AstanaCityPASS, EXPOPASS-is a single card for tourists with a continuous validity of 72 hours (3 days). Cards can be activated within 12 months after purchase. The start of activation is considered to be the time of electronic scanning, manual entry of data from the Card or making an appropriate entry in the guide at the first visit to the Museum or tour.

2.3. CityPASS cards provide the right to a one-time visit (free of charge) of the museums and excursions included in the program; the right to receive discounts from partners of the program according to the specified list in the guide and on the website. Museums and excursions on the CityPASS Card can be visited during the validity period of The Card; discounts and special offers are valid after the expiration date (in accordance with the terms of the contract with the partner);

2.4. To get a free pass to any attractions included in the CityPASS program, an electronic Astana CityPASS card and the Astana Travel Guide must be presented at the ticket office.

2.5. Maps Astana EXPO CityPASS and CityPASS are not refundable or exchangeable for cash. Damaged cards can be exchanged for new ones when contacting support. In case of violation of the rules of use, the Card will be blocked.

3. THE RIGHTS AND OBLIGATIONS OF THE OPERATOR

3.1. The operator regularly updates information on the program website. However, the mode of operation of attractions and other conditions may change, so users of CityPASS card is recommended to further clarify the current schedule directly at the Museum, tour organizer and so on. 3.2. The composition of the tourist Map includes the best sights of Astana. Cooperation is carried out on a contractual basis. If any of the partners do not provide the service properly, in violation of its obligations, the operator of the program is not seen as responsible. However, the Operator takes all possible measures to ensure quality service on the CityPASS Card and eliminate such situations.

3.3. The operator does not provide compensation for services on the CityPASS Card that the client did not use during the validity period of The Card, as well as for services that were not provided for force majeure and technical reasons that arose from partners. The operator notifies the CityPASS Card holders of such situations by publishing the news on The site as soon as possible.

3.4. The CityPASS card offer cannot be combined with other discounts offered by partners. If the partner has a higher discount than the one offered by CityPASS program during the visit, the client has the right to use a better offer.

3.6. According to paragraph 18 of the “rules of electronic Commerce”, approved by the order of acting Minister of national economy of Kazakhstan № 720 of November 25, 2015, the Operator acting as an intermediary between the organizer And the Buyer shall not be liable under contracts concluded with the use of electronic documents (electronic communications), in respect of which they have provided services.

3.7. The operator has the right at any time to change the terms of this Agreement unilaterally, while ensuring the publication of the amended terms on the site.

4. THE RIGHTS AND OBLIGATIONS OF THE BUYER

4.1. The buyer is solely responsible for the safety of the CityPASS card and all other additional investments of the package.

4.2. The buyer is obliged to familiarize himself with the internal rules of visiting attractions, excursions and institutions included in the CityPASS program (especially etiquette, dress code, visiting rules, etc.).

4.3. The buyer has the right to return the AstanaCityPASS card in case the card has not been activated yet, the moment of activation is considered to be the moment of electronic scanning, manual entry of Data from the Card or making an appropriate entry in the guide when visiting the Museum or excursion for the first time.

5. CARD REFUND TERMS

5.1. In case of cancellation of the purchase order AstanaCityPASS, the funds are transferred to the Bank card, the details of which were specified at the time of purchase.

5.2. The customer has the right to cancel the paid order at least 1 day before the date of delivery/receipt of the order. It is necessary to write request info@CityPASS.kz. The penalty for cancellation will be charged. The cards received on hands are not subject to exchange for money.

5.3. Card EXPOPASS not be returned or exchanged.

6. Prices and points of sale

6.1. CityPASS Card has a single price at all official points of sale. Due to the seasonality of the offer of some options, as well as the constant updating of the list of objects included in the program, the composition of the program may vary depending on the time of year. The operator does not guarantee the availability of all types of cards at all points of sale. It is recommended to specify this information directly in the item.

7. FORCE MAJEURE

7.1. The parties shall be released from liability for non-performance or improper performance of obligations under the Agreement for the duration of force majeure. Under force majeure refers to extraordinary and compelling circumstances that impede the fulfillment of obligations of the PARTIES under this Agreement. These include natural phenomena; the impact of a nuclear explosion, radiation (ionizing radiation) or radioactive contamination with nuclear weapons materials, production and research works or radioactive waste; war, military invasion, hostile actions of a foreign enemy, hostilities, military maneuvers and related activities of a military nature; civil war, armed rebellion, popular unrest of any kind, riots, violent seizure or forcible retention of power; epidemics, epizootics, weather conditions, terrorist actions, strikes, seizure, confiscation, requisition, nationalization, etc. Side of which came the above circumstances, should as soon as possible notify the other party about their occurrence. At the same time, well-known events do not need any confirmation, with respect to other events, it is necessary to annex the relevant supporting documents, which may be included but not limited to documents emanating from the competent state bodies.

8. THE ORDER OF CONSIDERATION OF CLAIMS AND DISPUTES.

8.1. Any differences or disputes that may arise will, to the extent possible, be settled by the parties through negotiations.

8.2. If the agreement for any reason is not reached during the pre-trial settlement, the dispute arising out of this Agreement shall be subject to consideration in the Arbitration court of Astana (if the Buyer is a legal entity or an individual entrepreneur), or in the court of General jurisdiction at the location of the Operator (if the Buyer is a natural person).

8.3. Claims of the Buyer on the provided services are accepted and considered by the Operator only in writing and in the order provided by the current legislation of RK.

8.4. To resolve technical issues in determining the fault of the Buyer as a result of his unlawful actions in the use of the System, the Operator has the right to independently attract competent organizations as experts. In case of establishment of fault of the buyer, the Last is obliged to reimburse expenses on carrying out examination.
